By accessing or using our website located at www.wlidaty.com ("Site") and the services provided through it ("Services"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). These Terms are entered into by and between you ("You" or "User") and Wlidaty ("We", "Our"), a company registered under the laws of Morocco.

Please read these Terms carefully before using the Site. If you do not agree to any of these Terms, please do not use the Site.

1. General Information

Wlidaty.com is an online E-Commerce platform specializing in wide variety and range of products These Terms and Conditions govern your use of the website and its associated Services. Wlidaty.com operates in compliance with Moroccan law, particularly the Moroccan Consumer Protection Law and Moroccan Law on Electronic Commerce (Law No. 53-05).

The domain name www.wlidaty.com is owned and operated by Wlidaty SARL AU, a company incorporated under Moroccan law with a registered office in Casablanca, Morocco.

2. Eligibility to Use the Site

The Site and Services are intended for use only by individuals who are at are capable of entering into legally binding contracts under Moroccan law. By using the Site, you represent and warrant that you meet these eligibility criteria.

Wlidaty.com reserves the right to refuse access to the Site to anyone at its sole discretion.

3. Account Registration

To access certain features of the Site, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update this information as necessary to maintain its accuracy. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

If you believe that your account has been compromised or unauthorized access has occurred, you must notify us immediately.

4. Use of the Site

You agree to use the Site for lawful purposes only and in compliance with Moroccan laws, including the Moroccan Consumer Protection Law, Law No. 09-08 on Protection of Personal Data, and Law No. 53-05 on Electronic Commerce. Specifically, you agree not to:

• Use the Site to transmit any unlawful, harmful, or offensive content, including viruses or malware.
• Interfere with or disrupt the operation of the Site or Services.
• Use the Site to engage in fraudulent activities or mislead other users.
• Violate any intellectual property rights or privacy rights.

Wlidaty.com reserves the right to suspend or terminate your access to the Site if you violate these terms.

5. Pricing, Promotions, VAT, and Payment

Pricing: All prices for products and services on the Site are listed in Moroccan Dirhams (MAD) and are inclusive of applicable Value Added Tax (VAT).

VAT Provision: In compliance with Moroccan tax laws, the prices displayed for products and services on the Site are inclusive of VAT at the prevailing standard rate, which is currently 20% (as of the effective date).

If the VAT rate changes or if new taxes are imposed, we will update the price of products accordingly, and the updated VAT rate will be reflected in the final total at checkout. You will be able to see the breakdown of VAT in your order summary before confirming your purchase.

Promotions and Discounts: Wlidaty.com may offer promotions or discounts from time to time. The terms of any promotion will be clearly specified on the Site, and such promotions may not include or may offer reduced VAT-inclusive prices. Any applicable discounts will be reflected in the final checkout price, which will include VAT.

Discount Codes: From time to time, Wlidaty.com may issue discount codes that can be applied to your order during checkout. These codes may apply to specific products or categories or to your entire order. The discount code must be applied during checkout to receive the discount.

Promotional Offers: Promotional offers, such as discounts, bundle deals, or free gifts, are subject to specific terms and conditions, including but not limited to minimum purchase requirements or product exclusions. Such offers may be limited in time and availability. For any returned or undelivered orders, whether partial or complete, the user will no longer be eligible to use the offer that was applied to the original purchase. Additionally, the benefit of the offer will not be included in any refund. The refund or replacement process will only be initiated once all products from the original order have been returned. Occasionally, we may include a free sample or gift with orders that are eligible for offers. These samples or gifts are not eligible for return, replacement, or refund under any circumstances.

Coupon Codes & Cart Offers
We occasionally offer special discounts through coupon codes. To prevent misuse, we have established guidelines for using these codes.

To maximize the benefits of coupon code offers, please note the following terms and conditions applicable to all coupon codes:

1. Coupon codes and cart offers are valid only when the coupon code is applied during checkout.
2. Coupon codes and cart offers are valid until the communicated expiration date or until stocks run out on applicable products, whichever comes first.
3. Each coupon code or cart offer can be used once per user, per household, unless stated otherwise.
4. Coupon codes and cart offers cannot be combined with any other coupon or ongoing site-wide offer, including non-coupon-based promotions.
5. The coupon will apply the stated discount or the discount already applied to the product, whichever is greater, unless specified otherwise.
6. Coupon codes that are issued individually to a user are valid only for that particular user’s purchases.
7. We reserve the right to change the terms and conditions of any coupon code at any time without prior notice.
8. Cashback coupons are valid only for future purchases, in accordance with the conditions outlined in the cashback offer.
9. Cash coupons added to an account may be updated or changed by Wlidaty.com at any time, without prior notice, even before the existing coupon’s expiration date.
10. Offers are valid only on the listed sizes and colors of products featured on the promotional page.
11. Coupon codes are not applicable to certain products. Click here to view the list of excluded products.
12. Coupon codes cannot be applied to combos.

Payment: You agree to pay all charges associated with your purchases on the Site using the payment methods provided on the Site. Payment must be made in full before any products or services are dispatched or provided. We accept payments through secure payment gateways including Debit Visa, Mastercard, Credit Cards and International Wire transfer. 

Wlidaty.com reserves the right to change product prices and promotions at any time without prior notice. However, any price change will not affect already confirmed orders.

6. Transactions & Cancellation

Minimum Order Value

To place an order on Wlidaty.com, the minimum order value must exceed MAD 50 (excluding charges, shipping fees, taxes, or any value adjustments due to the application of coupons or other promotions).

Credit Card Details

By providing your credit card information to complete transactions on our website, you confirm that the details you have entered are correct, accurate, and up-to-date. You also affirm that you are lawfully authorized to use this card for purchases on our website. You must not use any credit card that is not legally owned by you. You further agree to provide valid and correct credit card details. We will not share your card information with third parties, except when required for fraud verification purposes or as required by law, regulation, or court order. We are not liable for any credit card fraud; the responsibility for fraudulent use lies solely with you. It is your responsibility to prove otherwise in case of such an incident.

Fraudulent/Declined Transactions

In the event of fraudulent use of the site, Wlidaty.com reserves the right to recover the cost of the goods, collection charges, and legal fees from the responsible parties. We also reserve the right to pursue legal action for fraudulent use of the site, as well as any other unlawful actions or breaches of these terms and conditions.

Cancellations by the Customer

If you submit a cancellation request and the order has not yet been shipped, we will cancel the order and refund the full amount. However, once the order has been shipped, we cannot cancel the order, and you will need to refer to our Return Policy for any post-shipping issues.

Cancellation by Wlidaty.com

There may be certain circumstances where we are unable to fulfill your order, and in such cases, we reserve the right to cancel the order. We can refuse or cancel any order at our discretion, for reasons that may include, but are not limited to, limitations in available stock, inaccuracies or errors in product or pricing information, or issues identified by our fraud and credit departments. We may also request additional information or verification before accepting any order. If your order is cancelled after your payment has been processed, the amount will be refunded to your Wlidaty.com account as "Cash Refund". By placing an order, you agree not to dispute any decision made by Wlidaty.comregarding order cancellation.

Payment

When using any of the payment methods offered by Wlidaty.com, we are not responsible for or liable for any loss or damage that occurs due to:

1. Lack of authorization for the transaction;
2. Exceeding the limit mutually agreed upon between you and your bank;
3. Payment-related issues arising during the transaction process;
4. Transaction declines for any other reason.

All payments for purchases or services on Wlidaty.com must be made in MAD. We do not accept any other currencies for transactions on the website.

Before shipping your order, we may request supporting documents (such as government-issued identification and proof of address) to verify the ownership of the payment instrument used. This is done to ensure a secure shopping experience for our customers.

Loyalty Cash Usage

Loyalty Cash cannot be used when purchasing Gift Certificates on Wlidaty.com. The use of Loyalty Cash is restricted to other types of transactions as outlined in our Loyalty Program Terms.

7. Gift Cards

Wlidaty.com offers Gift Cards as a payment method for purchasing products or services on the Site. By purchasing, using, or redeeming a Gift Card, you agree to the following terms:

• Gift Card Purchase: Gift Cards are available for purchase in various denominations and can be bought through the Site. Gift Cards are only available in Moroccan Dirhams (MAD).
• Redemption: Gift Cards can be used as a form of payment for purchases on the Site. Gift Cards cannot be exchanged for cash or refunded, except as required by applicable law. If the total value of the Gift Card is not enough to cover the total price of an order, you must pay the remaining balance through another available payment method.
• Non-transferable: Gift Cards are non-transferable and may only be used by the individual who purchased or received the Gift Card. You must keep your Gift Card code safe and secure. Wlidaty.com is not responsible for lost or stolen Gift Cards.
• Expiration: Gift Cards are valid for 12 months from the date of purchase. After the expiration date, any remaining balance on the Gift Card will be forfeited.
• Refunds and Returns: If you return a product purchased with a Gift Card, the refund will be credited back to the same Gift Card or issued as a new Gift Card, depending on the terms of the return policy.
• Limits: Wlidaty.com reserves the right to set limits on the number of Gift Cards used per transaction and on the value of Gift Cards used in a single purchase.
• Fraud Prevention: We reserve the right to refuse or cancel Gift Card transactions that we suspect to be fraudulent. Any suspected misuse of Gift Cards will result in the suspension of your account and may lead to legal action.

8. Wlidaty Reward Program

Wlidaty.com offers the Wlidaty Reward Program, a loyalty program that allows registered users to earn rewards based on their purchases and engagement with the Site. By participating in the Wlidaty Reward Program, you agree to the following terms:

• Eligibility: The Wlidaty Reward Program is available to all registered users of Wlidaty.com who have made at least one purchase on the Site. Only users who are 18 years or older are eligible to participate.
• Earning Wlidaty Points: Users can earn Wlidaty Points for every qualifying purchase made on the Site. The number of points earned will be clearly stated at the time of purchase and may vary depending on the product or promotion. You may also earn Wlidaty Points through other activities, such as signing up for newsletters, sharing on social media, or referring friends to Wlidaty.com.
• Redeeming Wlidaty Points: Wlidaty Points can be redeemed for discounts on future purchases or for free products, depending on the rewards available at the time. Points are redeemable only on the Site and are not transferable for cash.
• Expiry of Points: Wlidaty Points may have an expiration date. Any points not redeemed within the expiration period will be forfeited. The expiration period will be stated in the user’s account.
• Non-transferability: Wlidaty Points are non-transferable and may only be used by the account holder who earned them. Points cannot be sold or exchanged.
• Program Changes and Termination: Wlidaty.com reserves the right to modify or terminate the Wlidaty Reward Program at any time without prior notice. Any changes to the program will be communicated to participants through the email associated with their account. In the event of program termination, any unredeemed Wlidaty Points will be forfeited.
• Fraud Prevention: Wlidaty.com reserves the right to disqualify any user from the Wlidaty Reward Program if it is determined that points were earned fraudulently or through violation of these Terms and Conditions.

9. Gift Registry

Wlidaty.com offers a Gift Registry service, allowing users to create personalized gift lists for special occasions such as birthdays, weddings, baby showers, or any other celebrations. By using the Gift Registry service, you agree to the following terms:

Eligibility and Creation of Gift Registry:

• You must be a registered user on Wlidaty.com to create a Gift Registry.
• To create a Gift Registry, you must provide accurate and complete information, including your name, contact details, and occasion for the registry.
• The registry is intended for personal use and should not be used for commercial purposes.

Adding Items to the Registry:

• You can add products available on Wlidaty.com to your Gift Registry by selecting the "Add to Registry" option on the product page.
• All products added to the registry are subject to availability and pricing at the time of purchase. Wlidaty.com reserves the right to remove products from the registry if they become unavailable or out of stock.

Sharing the Registry:

• Once your Gift Registry is created, you can share it with friends and family by providing them with a link to your registry.
• You may also customize the privacy settings of your registry to make it private (accessible only to invited individuals) or public (visible to anyone with the link).

Purchasing from the Registry:

• Friends and family can browse and purchase items from your Gift Registry directly on the Site.
• When a gift is purchased from your registry, the item will be removed from the registry list to avoid duplication of gifts.
• Purchases made from your Gift Registry are subject to the same Terms and Conditions as regular orders, including shipping, taxes, and return policies.

Gift Wrapping and Messages:

• Wlidaty.com may offer gift wrapping services for certain items. You may select this option when purchasing items from the Gift Registry.
• You may also include a personalized message for the recipient when purchasing gifts from the registry.

Returns and Exchanges:

• Returns or exchanges of gifts purchased from a Gift Registry are subject to Wlidaty.com's standard Return and Refund Policy.
• If the recipient of the gift wishes to return or exchange an item, the gift recipient or purchaser must comply with the return process outlined on the Site.

Expiration of Gift Registry:

• Gift Registries will remain active for 1 year from the creation date. After this period, the registry will expire, and any unpurchased items may be removed. You will be notified before the expiration of your registry.

Modification and Cancellation:

• You may modify or delete your Gift Registry at any time. Any changes made will be reflected in the registry immediately.
• Wlidaty.com reserves the right to suspend or terminate the Gift Registry service at its discretion without prior notice.

Gift Registry Fraud Prevention:

• Wlidaty.com reserves the right to cancel any Gift Registry that is found to be in violation of these Terms or used for fraudulent or unlawful purposes.

Limitation of Liability:

• Wlidaty.com is not liable for any lost or stolen gifts purchased from the Gift Registry or any issues related to the fulfillment of registry orders, including delivery delays, defects, or damages.

10. Flash Sales

What is a Flash Sale?

A Flash Sale is a limited-time promotion where specific products are offered at significantly discounted prices for a short period. Flash Sales are typically announced with a specified start and end time, and the discounted products are available only while supplies last.

Eligibility & Participation:

Flash Sales are open to all registered users who have an active account on Wlidaty.com. To participate, users must add the discounted products to their cart and complete the checkout process before the Flash Sale ends or while the available stock lasts. Flash Sales cannot be combined with any other ongoing promotions, discounts, or offers unless otherwise specified.

Flash Sale Duration:

Flash Sales are time-sensitive and will run for a limited period, which will be clearly communicated on the Site. The sale ends once the time limit expires or when the flash sale products are sold out. Wlidaty.com reserves the right to end the sale earlier than planned if all products in the sale have been sold.

Product Availability:

Flash Sale items are limited in quantity. Once the available stock for a Flash Sale product is sold out, no further purchases will be allowed. Wlidaty makes no guarantee that any product will remain available for the full duration of the Flash Sale.

No Price Adjustments:

Once an order is placed during a Flash Sale, no price adjustments will be made for the same product if the price changes during the sale period. Flash Sale prices are fixed for the duration of the sale.

Return and Refund Policy for Flash Sale Products:

Products purchased during Flash Sales are subject to Wlidaty’s standard Return and Refund Policy. However, we reserve the right to limit or exclude returns for certain discounted Flash Sale items in the event that they were clearly marked as non-returnable or final sale items.

Flash Sale Notifications:

Customers who wish to receive notifications for upcoming Flash Sales can sign up for Wlidaty's newsletters, follow our social media accounts, or enable notifications via the Site. We will notify users of Flash Sale events ahead of time, but availability is still subject to the limited nature of these promotions.

Wlidaty's Rights:

Wlidaty reserves the right to modify or cancel any Flash Sale at its discretion. If a sale is canceled or modified, we will notify users who have made purchases, and appropriate adjustments or refunds will be issued if necessary.

11. Order Processing, Delivery, and Cancellations

At Wlidaty.com, we aim to provide a smooth and efficient shopping experience for our customers. The following outlines our order processing, delivery, and cancellation policies. Please read carefully to understand the timelines and procedures.

Order Processing

Orders placed on Wlidaty.com will be processed according to the following guidelines:

• Order Confirmation: Once an order is placed, you will receive an order confirmation email containing the details of the items purchased, including the estimated delivery time.
• Processing Time: After receiving the order, our team will process the order during our business hours (Sunday to Thursday, 9:00 AM - 6:00 PM). Orders placed after business hours or on weekends and holidays will be processed on the next business day.
• Order Cut-off Time: For customers located in Casablanca and Rabat, any orders placed before 2:00 PM (local time) will be processed for same-day delivery. Orders placed after 2:00 PM will be processed for delivery the next business day.
• Orders from Other Cities: For all other cities within Morocco, orders placed before 2:00 PM will typically be processed for delivery within 24 hours. Orders placed after the cut-off time will be processed and shipped the following business day.

Order Modifications:

• Once an order has been placed, it cannot be modified. You will need to wait until you receive your order to request a return, exchange, or refund.

Delivery

We are committed to delivering your order as quickly and safely as possible. Delivery timelines are as follows:

• Casablanca & Rabat: For orders placed before 2:00 PM, we offer same-day delivery. Orders placed after the cutoff time will be delivered the next business day. We strive to complete all deliveries within the same day, but in rare cases, delivery may take slightly longer due to unforeseen circumstances.
• Other Cities: For cities outside Casablanca and Rabat, orders will be delivered within 24 hours of order placement, provided that the order is placed before 2:00 PM. For orders placed after the cut-off time, the delivery will be made within the next business day.
• Shipping Methods: All orders will be shipped via trusted courier services. We will choose the most efficient and reliable delivery method based on your location.
• Delivery Charges: Delivery charges will vary based on the destination city and the size of the order. The total shipping fee will be displayed during checkout before you confirm your order.

Cancellations

We understand that circumstances can change, and you may need to cancel your order. Our cancellation policy is designed to provide flexibility to our customers:

• Cancellations Before Shipment: You can cancel your order free of charge at any time before it is shipped. To cancel an order, please contact our customer support team immediately via email or phone. If the order has not yet been processed for shipment, we will cancel it and issue a full refund to your original payment method.
• Cancellations After Shipment: If your order has already been shipped, we will be unable to cancel it. However, you can still return the product by following our Returns & Refunds Policy once the product has been delivered to you.
• Unsuccessful Deliveries: If our delivery team is unable to deliver your order due to incorrect or incomplete address details, or if you are unavailable to receive the package, the order may be canceled and returned to us. In such cases, we may charge a cancellation or re-delivery fee, and you may be refunded only the product value (excluding any shipping charges).

Address Accuracy

• It is essential that you provide accurate and complete address details when placing your order. Any incorrect or incomplete addresses may result in delivery delays or failed deliveries. Please double-check your address before confirming your order.

Delayed Deliveries

While we strive to deliver your order within the specified timelines, certain factors beyond our control (e.g., weather conditions, road closures, holidays, etc.) may cause delays. In such cases, we will keep you informed via email or phone regarding the status of your delivery.

12. International Orders

Eligibility for International Orders:  

Wlidaty.com primarily operates and delivers products within Morocco. However, we understand the global nature of e-commerce and we accept orders from customers outside Morocco. If you are placing an order from outside Morocco, you agree to comply with the following terms and conditions related to international orders.

International Shipping:  

International orders are subject to additional shipping charges and delivery times, which will be calculated and sent to the customer after the checkout process. The shipping cost and delivery time may vary depending on the order size (weight / dimensions) and destination country.

Delivery Time: 

Delivery times for international orders can vary significantly based on the destination. While we strive to provide accurate delivery estimates, we are not responsible for any delays caused by customs procedures, shipping carrier issues, or other external factors beyond our control.

Customs Duties, Taxes, and Import Fees:

All international orders are subject to customs duties, taxes, and import fees imposed by the destination country. These fees are the responsibility of the customer and are not included in the price of the products or shipping fees at checkout. 

• You are responsible for paying any additional charges for customs clearance in your country.  
• Wlidaty.com is not responsible for any delays in delivery or the refusal of delivery due to customs procedures, customs duties, or other import restrictions.
• We advise that you check with your country's customs office for information regarding potential import taxes and regulations before placing an international order.

Currency and Payment:  

Prices displayed on Wlidaty.com are listed in Moroccan Dirhams (MAD). For international orders, you may be billed in your local currency based on the exchange rate at the time of the transaction, as determined by your payment provider. You agree to pay any applicable foreign transaction fees or charges imposed by your payment method.

Order Processing for International Orders:  

Once your international order is placed, you will receive an order confirmation email. Your order will be processed and shipped once all items are in stock. You may receive multiple shipments for international orders if the products are sourced from different locations.

International Order Restrictions:  

Certain products on the Site may not be available for international shipping due to legal, regulatory, or logistical reasons. Wlidaty.com reserves the right to refuse or cancel any international order if it does not comply with the shipping policies or international trade regulations.

Return and Refund for International Orders:

Wlidaty.com’s return and refund policy applies to international orders, but you are responsible for all shipping costs associated with the return of products. If a product is returned from an international order, any applicable duties, taxes, or import fees will not be refunded.

13. User Conduct

15. Intellectual Property

You may not copy, modify, or distribute any content from the Site without prior written consent from Wlidaty.com, except as allowed under applicable law.

16. Limitation of Liability

Wlidaty.com will not be held liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or any products purchased through it, even if we have been advised of the possibility of such damages. Our liability will be limited to the amount you paid for the product or service in question.

17. Indemnification

You agree to indemnify and hold harmless Wlidaty.com, its officers, directors, employees, agents, and affiliates from any claim, liability, loss, or expense (including legal fees) arising out of your use of the Site or your violation of these Terms.

18. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of Morocco. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Casablanca, Morocco.

19. Modification of Terms

Wlidaty.com reserves the right to update or modify these Terms at any time. All changes will be posted on this page, and the updated Terms will be effective immediately upon posting. By continuing to use the Site after the changes are posted, you agree to be bound by the revised Terms.

20. Warranty 

General Warranty

At Wlidaty.com, we strive to offer high-quality products. Most products sold on our platform come with a manufacturer’s warranty that covers defects in materials or workmanship. The duration of the warranty may vary depending on the product and manufacturer. The specific warranty details for each product will be listed on the product page.

Coverage

Our warranty covers:

• Defects in materials or craftsmanship.
• Malfunction or failure of the product under normal use within the warranty period.

Exclusions

The warranty does not cover:

• Damages caused by improper use, misuse, accidents, or neglect.
• Damage resulting from unauthorized repair or modification.

• Damage caused by natural disasters or environmental factors (such as extreme temperatures, moisture, fire, etc.).

Warranty Claims

2. Return/Exchange Process: In some cases, we may require the product to be returned for inspection. If the defect is confirmed, we will either repair or replace the product, or issue a refund (depending on the product type and manufacturer’s policy).

Limitation of Liability

Wlidaty.com shall not be held liable for any damages, loss of use, or any other indirect or consequential damages resulting from the use of the product under warranty. The extent of our liability is limited to the repair, replacement, or refund of the defective product.

Manufacturer’s Warranty

In cases where the product is covered under a manufacturer’s warranty, the terms and conditions of that warranty will apply. If the manufacturer’s warranty period extends beyond the coverage provided by Wlidaty.com, the manufacturer’s warranty terms will take precedence.

21. Copyright & Trademark

All content on this Site, including Microsites, is the exclusive property of the owner and may only be used with the express permission of the copyright and/or trademark holder.
